Governor Eric Holcomb signed SB 480 on Wednesday.
In a public statement regarding the bill Gov Holcomb stated, “Permanent gender-changing surgeries with lifelong impacts and medically prescribed preparation for such a transition should occur as an adult, not as a minor."
Within hours of the bill signing, the ACLU responded with a lawsuit. The ACLU also brought suit, successfully, against the state of West Virginia, which is now forced to allow males to compete in women's sports.
The lawsuit, filed in federal court, alleges that SB 480 is unconstitutional in that it violates the Equal Protection Clause and the Fourteenth Amendment.
It also claims that SB 480 violates the federal requirements of the Medicaid Act and the Affordable Care Act, because it "prohibits essential medical services that would otherwise be authorized and reimbursed by Medicaid," according to the ACLU.
The Indiana bill won approval by wide margins in both the House and Senate.
The ACLU also intends to challenge new and proposed bans on gender-affirming care in Tennessee, Oklahoma, Kentucky, Utah, and Montana.
A large amount of the court cases have targetted Indianna parental rights and have resulted in an alarming amount of rulings stripping mothers and fathers across the state of the right to parent their own children.
Most of these rulinings are based on an idea pushed by trans rights groups that the refusal of a parent to go along with their child's idea of gender identity constitutes child abuse.
Over the last year, shock and outrage has spread across Indianna as an increasing amount of trial court rulings have resulted in parents losing custody of their children and the children being placed in the custody of the State.
In some cases parents have been granted visitational rights to their children but are forbidden to speak about gender related issues.
The children are then refferred to state appointed case workers who take over all trans related issues regarding healthcare.
Years of these type of rulings have created broken families and multitudes of desperate parents being dragged through tedious appeals. In most cases their appeals are denied and the State's role as guardian and caregiver is upheld.
Legally hobbled by these rulings, parents watch from the sidelines as workers from trans rights groups take the parental reigns and guide minors into treatments ranging form hormone therapies to puberty blockers to gender reassignment surgeries.
When Governor Holcomb signed SB40 on Wednesday, he took the first steps toward reestablishing parental rights, something trans activists groups are often at odds with.
