A Pennsylvania judge has ordered that segregated ballots should not be counted, ruling that the State Secretary Kathy Boockvar "lacked statutory authority" to override the election law.
Based on the secretary of state's "interpretation and application" of the state Supreme Court's decision in Pennsylvania Democratic Party v. Boockvar, President Judge Mary Hannah Leavitt concluded that Boockvar "lacked statutory authority" to issue the Nov. 1 guidance to Respondents County Boards of Elections, purportedly changing the deadline of the state's election code "for certain electors to verify proof of identification."
The ruling stated that the aforementioned county board are "enjoined from counting any ballots that have been segregated" pursuant to the court's order dated Nov. 5, granting a special injunction.
Prominent lawyer Harmeet Dhillon clarified: "This has to do with ballots where first-time voters didn't provide proof of identity within 6 days after the election, NOT the PA Supreme Court ruling allowing ballots to be counted if received up to 3 days after e-day."
Dhillon added that it's unclear how many first-time voters are affected by this action, because "they didn't produce this information a full six days after the election."
"It IS a win and its reasoning SHOULD extend to the late ballots too, but that is before SCOTUS still," she declared.
Some individuals are interpreting this as a ruling on both issues, Dhillon continued. "[I]t's almost certain the 10k+ ballots admittedly received after election day are likely greater in volume than this category, but we don't know yet."
There are more hearings coming up next week in the state, she noted. "Stay tuned."
On Nov. 6, Justice Samuel Alito issued an order from the Supreme Court instructing that ballots received after 8 p.m. on Election Day in Pennsylvania are to be "segregated and secured."
Last week, state Senate leaders wrote in a statement that Boockvar "fundamentally altered the manner in which Pennsylvania's election is being conducted."
Mainstream media ignored the plight from Senate President Pro Tempore Joe Scarnati (R-25) and Majority Leader Jake Corman (R-34) calling for Boockvar's immediate resignation in light of her alleged "numerous actions to undermine public confidence in Pennsylvania's elections."
"Critically, the state has a Republican state legislature," reported Fox News journalist Kyle Becker. "#SCOTUS may ultimately decide the case now."
