"Yes he is, he is a suspect, based on the briefing from my law enforcement officials," New York City Mayor Eric Adams said in a Wednesday interview with Bloomberg. "He has now been upgraded to a suspect."
Adams said that the upgrade in status came "based on a briefing from my law enforcement officials and the evidence that we were able to accumulate."
The NYPD said James has connections to New York City, New Jersey, Pennsylvania, Wisconsin, and Ohio.
Just before 8:24 am on Tuesday morning, the shooter, who was on an incoming, northbound N train to the 36th Street MTA station in the Sunset Park neighborhood of Brooklyn, placed a gas mask on his face and deployed smoke bombs. Shortly after, he began shooting.
Video shows passengers fleeing the train car in fear, while injured passengers collapse on the train platform.
Later Tuesday evening, the New York Police Department published James’ photo, and said that he is a "person of interest."
"We have no one in custody at this time. We are looking for Frank James, we know he rented this U-Haul van. The key of that U-Haul van was found at the crime scene in the subway," NYPD Chief Essig said in a press conference on Tuesday evening.
It was revealed that evening that James had made "concerning posts" online, and that James had reportedly been known to the FBI, but was cleared from their watchlist in 2019.

In a March 2022 video uploaded to YouTube, James expressed the hope that humanity would be exterminated because of the damage people have done to the environment.
In one video he said, "Mr. Mayor, I'm a victim of your mental health program, I'm 63 now full of hate, full of anger, and full of bitterness."
The NYPD has stated that they are not investigating the attack as an act of terrorism.
Of those that were shot, five remain in the hospital in critical but stable condition.
