On January 13, 2020, The Post Millennial sent freelance journalist Amy Eileen Hamm to the Surrey Courthouse in British Columbia. Hamm was tasked with covering the appearance of notorious trans activist Jessica Yaniv, who was being heard on multiple prohibited weapons charges.
Yaniv rose to global infamy in 2019 after taking 16 primarily immigrant women to the Human Rights tribunal for refusing to wax Yaniv’s male genitalia. Following Yaniv’s increased profile, a series of young women came forward alleging Yaniv had sexually groomed them when they were minors, with one alleging Yaniv had even tried to share child pornography with her.
But even though Yaniv ultimately lost the genital-waxing cases at the BCHRT, the story is far from over.
On January 15, two days after Hamm’s journalistic assignment concluded, Jessica Yaniv accused the young writer of committing a horrific crime.
Yaniv accused Hamm of sexually assaulting JY, alleging she committed the heinous act inside the heavily surveilled Surrey Courthouse during the recess of Yaniv’s hearing. On the day of Yaniv’s hearing, the transwoman had accused Hamm of “taking photos” of Yaniv inside the washroom, with Hamm live-reporting her phone had been searched by sheriffs immediately on-site and dismissing her of having committed any wrongful acts.
Shortly after, Hamm expressed interest in launching a defamation suit against Yaniv. A prominent feminist activist, Hamm was horrified at the allegations. Her case had been forwarded by two prominent Canadian lawyers, and on January 22, they issued conditions to Jessica Yaniv that would cease the advancement of the defamation suit.
Yaniv ignored the conditions, instead issuing a countersuit on March 9, one that claimed Amy Eileen Hamm had indeed committed sexual assault, and that she had been criminally charged by the Surrey RCMP for the crime.
The Post Millennial reached out to the Surrey RCMP’s media division on March 9, and El Sturko advised that no charges were pending.
But in a bizarre turn of events, Hamm was contacted by Constable Bernard LaPointe almost immediately after The Post Millennial’s media inquiry, and her presence was demanded at the police station.
“One of the first things he said to me was that I am a suspect in a voyeurism investigation and that I needed to come to the Surrey police station to provide a statement.” Hamm said, providing The Post Millennial with a full testimonial of what occurred on January 13. Hamm states she was “tearful and distressed,” encouraging the officer to review the CCTV tapes from the courthouse, knowing they would immediately exonerate her.
“He made a flippant comment to the effect of ‘If you come here to make a statement, I won’t arrest you.’ I wasn’t sure if that meant that he intends to arrest me if I don’t go and make a statement.”
Constable Bernard LaPointe is also allegedly handling the cases of Rebel News reporter Keean Bexte, who was assaulted by Jessica Yaniv on camera the same day Yaniv claimed Hamm committed sexual assault, and Donald Smith, an intellectually disabled citizen journalist who Yaniv has waged a campaign of terror against.
Amy Eileen Hamm is a young mother of two small children, one of whom is still breastfeeding. In the testimonial she provided to The Post Millennial, she writes “I am terrified of the police separating me from my baby, who I co-sleep with every night.”
Hamm also writes that it should be “blatantly obvious … there is no merit to Yaniv’s claims.”
Multiple witnesses have been available to substantiate Hamm’s assertions that when she entered the washroom on January 13 and saw Jessica Yaniv, she immediately exited out of fear.
Chris Elston was seated with Hamm during the brief court recess. Hamm had asked Elston whether he noticed Yaniv’s presence prior to going to the washroom, hoping to avoid the much larger individual due to Yaniv’s frightening history with women and girls. Elston offered himself as a witness to that Hamm rapidly entered and exited the washroom, calling Bernard LaPointe of the RCMP multiple times.
“I left messages over a couple of weeks in January, and two messages this week.” Elston told The Post Millennial, “[LaPointe] claimed to never have received them.”
Elston’s experience parallels Hamm and her lawyer’s, both having attempted contact with LaPointe multiple times prior to his shocking call to Hamm on March 10 to no avail.
Of the greatest concern is the status of the CCTV tapes from the Surrey Courthouse which Hamm says exonerate her and substantiate her story. Hamm’s legal team attempted to retrieve the tapes from the Surrey Courthouse after LaPointe’s call, only to be told they are discarded every 30 days.
In a staggering show of incompetence, it is uncertain if Constable LaPointe acted upon the advice of witnesses and Hamm herself and acquired the crucial video evidence in time.
Most concerning is that the Surrey RCMP’s actions seem to be falling in line with Jessica Yaniv’s claims on the March 9 countersuit. In the legal document, Yaniv claimed the Surrey RCMP would be, or had, decided to charge Hamm.
“It is reprehensible that a woman (me) is being investigated by the police for simply entering a public women’s washroom for a second of time.” Hamm writes in her testimonial, “A washroom where a known violent, vexatious and male-bodied person was present, making me feel afraid inside a space that should be a haven for me.”
Hamm’s ordeal is still developing, but lays bare the issues with self-identification that many have been speculating on. In this instance, the complicity of law enforcement is concerning many, as a young mother is terrorized by a known predator and vexatious litigant—this time, with the apparent backing of the Surrey RCMP.
