A federal judge in Louisiana says President Biden doesn’t have the authority to bypass Congress and force healthcare workers to get vaccinated against COVID-19.
The nationwide injunction he issued on Tuesday pertains to the mandates issued for Medicare and Medicaid employees (no matter whether they were full-time or part-time).
The lawsuit was brought forward in Louisiana and thirteen other states joined in.
Judge Terry A. Doughty of the US District Court for the Western District of Louisiana wrote the following:
"There is no question that mandating a vaccine to 10.3 million health care workers is something that should be done by Congress, not a government agency. It is not clear that even an act of Congress mandating a vaccine would be constitutional."
It expands on a Monday order issued by a federal court in Missouri that applied to the ten states in a lawsuit against the Biden administration’s demand to have all healthcare workers in hospitals or nursing homes fully vaccinated by January 4th.
Fox News uploaded all 34 pages of the nationwide injunction. Judge Doughty said it’s inevitable that this case will be decided by a "higher court than this one," likely alluding to a Supreme Court decision down the line.
But for the time being Doughty said it was best to protect the interests of people with jobs and the loss of tax revenue that mandates would incur. The Louisiana Attorney General celebrated the ruling earlier today.
(This news is separate from the other court ruling today where a federal judge blocked the vaccine mandate for government contractors in three states.)
