WATCH: Attorney Marina Medvin describes the political persecution of Jan 6 client to Dinesh D'Souza

It comes alongside the release of new footage showing peaceful interactions between officers and protesters on the day of the riot.

Attorney Marina Medvin described to Dinesh D’Souza on Thursday how disproportionate the punishment of her client, Rabbi Michael Stepakoff, was for him solely walking into the Capitol building on the day of the riot, and shaking hands with an officer before leaving.

Their interview comes alongside newly released footage showing several instances of Capitol protesters shaking hands with officer personnel.

Medvin is a criminal defense attorney that’s currently overseeing six different January 6 defendant’s cases. D’Souza tried to get Medvin on his show for quite some time, but she has a policy of not discussing ongoing cases. It’s only because Michael Stepakoff’s case recently wrapped up that she agreed to openly discuss it on Dinesh’s show.

"Rabbi Mike is the leader of a congregation in Florida, and he came to Washington DC in order to take part in a protest (just like everyone else) seeking election integrity – seeking fair elections, for his voice to be heard – for the voice of his congregates to be heard. And he followed a crowd into the Capitol building, he was there for a total of five minutes, inside he shook hands with a police officer, he walked out."

Despite not committing any acts of violence, authorities charged him and executed a search warrant at his house anyway. Marina goes on to explain Stepakoff’s sentencing of one-year probation with two months of home incarceration.

Dinesh reiterates how Rabbi Mike said he saw no violence and saw cops interacting with the protesters, shaking hands.

Marina makes it clear that she requested the relevant footage of January 6 protesters shaking hands with capitol officers to be made public.

"And you’ll see a crowd of peaceful protesters walking into the Capitol, through open doors, and you’ll see police officers there and the police officers aren’t asking anyone to leave. They’re interacting positively with the individuals walking in, they’re shaking hands. I was able to count seven individuals walk up to police officers during that five-minute video and shake hands."

Dinesh said the prosecution tried to use video footage from twelve minutes before Rabbi Mike’s arrival, and thirty minutes after he left, to make their case. He asserts that the argument trying to be made by them was that the Rabbi was somehow responsible for the collective actions of the Capitol riot crowd. Marina agrees with that summation because that’s the argument she made to the Judge amid the case’s proceedings.

It’s mentioned how protesters who disrupted the Kavanaugh proceedings in 2018 got a $50 fine and their cases dismissed. Even though the conduct there was more egregious being in the Senate gallery, compared to Rabbi Mike being in an outside hallway by the building’s front door.
